IMPORTANT SUMMARY (plain English)
- Mentor AGI is an AI tool. It can be wrong. You must verify before you publish, send, or act.
- We do not guarantee results (SEO rankings, leads, sales, ad performance, etc.).
- You (the Site Owner) are responsible for what is shown on your website and how you use visitor data.
- To the maximum extent permitted by law, our liability is limited.
1) Agreement and acceptance
These Terms of Use (“Terms”) govern your access to and use of Mentor AGI
(the “Service”).
By installing, accessing, or using the Service, you agree to these Terms.
If you do not agree, do not use the Service.
2) Definitions
“Site Owner” = a Wix user/business that installs or uses the Service for one or more Wix sites.
“Site Visitor” = a visitor who interacts with the Service on a Site Owner’s site.
“Input” = text, content, files, settings, or instructions submitted to the Service.
“Output” = responses, suggestions, and generated content produced by the Service.
3) Relationship to Wix
The Service is offered through the Wix platform, but it is provided by Air Duct Cleaning Co. LTD.
Wix is not responsible for the Service. Your use of Wix is governed by Wix’s own terms and policies.
4) Eligibility
You must be able to form a legally binding contract to use the Service.
If you use the Service on behalf of a company, you confirm you have authority to bind that company.
5) What the Service does
The Service may include features such as:
- AI chat and automated responses on websites
- lead capture and contact/booking flows (if enabled)
- SEO analysis and content generation (titles, meta descriptions, headings, intro/body copy, etc.)
- publishing/implementation workflows through Wix-related mechanisms (if enabled)
Features may change over time and may not be available in all plans or configurations.
6) AI Output is not guaranteed (no professional advice)
The Service uses automated systems (including AI). Outputs can be incorrect, incomplete, misleading, or not suitable for
your situation. You are solely responsible for reviewing, testing, and verifying Outputs before using them in:
- your website content
- marketing/SEO
- advertising (including Google Ads)
- customer communications
- operational decisions
The Service does not provide professional advice (legal, financial, medical, accounting,
or other regulated advice).
7) Site Owner responsibilities (critical)
If you are a Site Owner, you are responsible for:
a) Your content and claims: Any text, pricing, offers, guarantees, and statements published on your site.
b) Legal compliance: Compliance with laws and platform rules that apply to your business and your visitors.
c) Visitor notice and consent: Providing required privacy notices and obtaining any required consent for cookies/tracking and
collection of visitor contact data.
d) Visitor data handling: How you store, use, and respond to lead/contact information collected through the Service.
8) Acceptable use (prohibited behavior)
You must NOT use the Service to:
- break any law or regulation
- deceive, defraud, or impersonate others
- collect personal data without required notice/consent
- send spam or unlawful marketing
- upload malware or attempt to disrupt the Service
- attempt unauthorized access, reverse engineering, or bypassing security controls
- overload the Service via abuse, automated attacks, or scraping
We may suspend or terminate access if we reasonably believe the Service is being misused.
9) Your Inputs and permissions you grant us
You retain ownership of your Inputs.
To operate the Service, you grant us a limited, non-exclusive right to
host, process, transmit, and use Inputs and related data only to:
- provide the Service and generate Outputs
- maintain and secure the Service
- troubleshoot and improve reliability
- comply with legal obligations and enforce these Terms
You represent that you have the rights needed to submit any Inputs
(including third-party content).
10) Privacy and data processing
Our Privacy Policy (effective 2025-12-26) explains how we handle personal data.
In many cases:
- For Site Owner account/support/billing data, we act as a data controller.
- For Site Visitor interactions on a Site Owner’s site, the Site Owner typically acts as controller and we act as processor/service provider.
11) Third-party services (including AI providers)
The Service may use third-party providers for hosting, monitoring, messaging/email delivery, and AI generation.
These providers may process Inputs and technical data as needed to operate the Service.
12) Fees and subscriptions (if applicable)
If you use a paid plan, pricing and billing terms will be shown in the relevant checkout/app listing or dashboard.
Unless required by applicable law, fees are non-refundable. Taxes may apply and
are your responsibility.
13) Intellectual property
We own the Service, including software, design, and branding, except for your Inputs.
You may not copy, modify, distribute, sell, or reverse engineer the Service unless permitted by law or by us in writing.
14) Changes to the Service
We may update, add, remove, or change features at any time.
We do not guarantee uninterrupted availability.
15) Suspension and termination
You may stop using the Service at any time by uninstalling it from your Wix site.
We may suspend or terminate access immediately if:
- required by law, or
- you violate these Terms, or
- we reasonably believe there is abuse or security risk.
16) Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”.
WE DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY.
WE DO NOT WARRANT THAT:
- the Service will be uninterrupted, secure, or error-free,
- Outputs will be accurate, complete, or reliable,
- the Service will achieve any specific business result.
17) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
a) No indirect damages: We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or business interruption.
b) No guaranteed outcomes: We are not liable for outcomes related to SEO rankings, traffic, leads, conversions, sales, or advertising
performance.
c) Platform/third-party risks: We are not liable for issues caused by Wix or third-party platforms/services (including outages, changes, deprecations, or incompatibilities).
d) Liability cap: Our total aggregate liability for any claim related to the Service will not exceed the greater of:
(i) the amount you paid us for the Service in the 3 months before the event giving rise to the claim, or
(ii) USD 100,
whichever is greater. If you paid nothing, the cap is USD 100.
Nothing in these Terms limits liability that cannot be limited under applicable law (for example, where prohibited).
18) Indemnification (Site Owners)
If you are a Site Owner, you agree to defend, indemnify, and hold harmless Air Duct Cleaning Co. LTD and its affiliates, officers, directors, employees, and agents from and against claims, damages, liabilities, losses, and expenses (including reasonable legal fees)
arising from:
- your website content and claims,
- your use of Outputs,
- your collection/use of Site Visitor data,
- your breach of these Terms or applicable law,
- your violation of platform policies.
19) Governing law and disputes
These Terms are governed by the laws of Thailand, without regard to conflict-of-law rules.
Disputes shall be brought in the competent courts of Thailand, unless mandatory local law requires otherwise.
20) Changes to these Terms
We may update these Terms from time to time. We will update the Effective date.
If you continue using the Service after changes, you accept the updated Terms.
